Prime Minister Prayut Chan-ocha, in his capacity as head of the National Council for Peace and Order, has invoked Section 44 of the interim constitution to suspend the selection of Constitutional Court judges pending the promulgation of an organic law regarding charter court judges.
The move was intended to ensure continuity of the performance of duty of the Constitutional Court in case the term of any judges of the court has expired while the organic law is yet to be promulgated. This means that the judges in question will continue to perform their duty after the expiry of their term until there is a selection process under the new law.
This arrangement is also applicable to members of the other charter-mandated independent organizations such as the Election Commission, the National Human Rights Commission and the auditor-general.
